Zoning Board of Appeals

Duties:

In the Town of Hurley it is the responsibility of the Code Enforcement Officer (CEO) or Zoning Enforcement Officer (ZEO) to ensure all residents adhere to the Hurley. You will be given the determination made by the  CEO/ZEO. You may require a variance from these regulations, if that is the case you may petition the Zoning Board of Appeals for either a Use Variance or an Area Variance. An Area Variance is a request to be allowed to deviate from the dimensional requirements. For example if you are proposing to build a deck, but it won't meet the setbacks. The Zoning Board reviews each case presented to them and decides if a variance is appropriate. This Determination is based on the criteria in Chapter 210 (Zoning) of the Town Code. The Town Code link is on the main page. A Use Variance is a request made to the Zoning Board when the CEO has told you that your proposed use is not allowed in the District you want to do it in. If you disagree with the ZEO/CEO's Determination, you may appeal it to the Zoning Board for an Interpretation. If you are designing a project and you know you will need an Area Variance, you can go directly to the Zoning Board, but in Hurley you need a Code Compliance Review Form from the ZEO/CEO to accompany you Application. The only exception to this is if you are before the Planning Board and a situation arises that it is determined you need a variance. A report by the Consultant for the Planning Board can act as the Code Review Form. It is important that residents understand local zoning regulations by speaking with the Building Department, and apply for any necessary variances prior to beginning a project. The Zoning Board meets on the second Thursday of each month at Town Hall @7:00PM.
